What is RA 9262?
Republic Act 9262 otherwise known as the Violence Act of 2004 or the Violence Against Women and Their Children was enacted in behalf of women who are being physically or mentally abused.
1. Definition of Terms
RA 9262 refers to any acts Or a series of acts committed by any person against a woman who is his wife, former wife, or against a woman with whom the person has or had a sexual or dating relationship, or with whom he has a common child. RA 9262 refers also to violence committed against his child whether legitimate or illegitimate, within or without the family abode and which shall result in or likely to result in physical, sexual, psychological harm or suffering, or economic abuse including threat of such acts, battery, assault, coercion, harassment or arbitrary deprivation of liberty.
2. Who are qualified under RA 9262
Women employees of private sector who are victims as defined in RA 9262, who are entitled to the paid leave benefit under such terms and conditions as provided herein.
The Leave benefit will cover the days that the woman employee has to attend to including medical and legal concerns.
3. Requirement/Qualification for the program.
Main requirement to avail of this leave benefit is – the victim-employee must present to her employer a certification from the Barangay Chairman ( Punong Barangay), Barangay Concilor (Barangay Kagawad), Prosecutor or Clerk of Court as the case maybe or that an action/ relative to the matter.
4. Benefit
In addition to other paid leaves, under existing labor laws, company policies and/or collective bargaining agreements. The qualified victim-employee shall be entitled to a leave of up to ten (10) days with full payment, consisting of basic salary and mandatory allowances fixed by the Regional Wage Board, if any.
The said leave can be extended when the need arises as specified in the protection order issued by the Barangay or the court.
5.Usage of RA 9262 benefit
The 10-day leave benefit shall be at the option of the woman-employee. In the event that the leave benefit is not availed of, it shall not be convertible into cash and shall not be cumulative.
