Have you experienced getting hold of a copy of your Live Birth from your Local Civil Registrar only to find out that the entries of your date of birth is erroneous or Worst – Knowing that what is reflected in your birth certificate is that you are a “Male” instead of being a “Female” or the Other way around?
The said problem is such a dilemna to most of our citizenry. What with the long list of documentary requirements plus the never ending process in the court proceedings, and not to mention the monetary issues.
The provisions of RA 10172 serves as the solution for such problem. Republic Act 10172 is entitled as “An Act Further Authorizing the City or Municipal Local Register or the Consul General to Correct Clerical or Typographical Errors in the Day and Month in the Date of Birth OR Sex of a Person Appearing in the Civil Register without the Need of a Judicial Order Amending for this Purpose, Republic Act Numbered Ninety Forty Eight (9048).
Number of persons are all too eager to avail on the provision of the new law. However, the Office of the Philippine Statistics Authority reiterates to the general citizenry that RA 10272 simply expanded the correction of the clerical or typographical errors in the Civil Register without Judicial Order as earlier provided in RA 9048. Thus RA 10172 is a CONSOLIDATION of Senate Bill 3113 and House Bill No. 4530. The provision of the new law aims to relieve the burden from the Petitioner, the inconvenience in getting through court proceedings for the correction of the problematic entry in the birth records.
A. Who May File the Petition?
* For correction of entry in the Day and/or Month in the date of birth
The petition must be filed by the owner of the documents. For cases of Minors or Persons who are Physically Incapacitated, the spouse, children, parents, brothers, sisters or legal guardians can file in behalf of the petitioner.
* For correction on clerical or typographical error in Sex
The owner or petitioner must personally file the petition in the local civil registry office where the Birth Certificate is registered.
B. Where to File the Petition?
The petition for the correction in the Date and Month of the Date of Birth OR Sex of a Person Must be Filed at the Local Civil Registry Office and not at PSA office.
C. Documentary Requirements for the Petition
1. Earliest school records or earliest school documents
2. Medical Records
3. Baptismal Certificate or other documents issued by religious authorities
4. Clearance or Certification that Petitioner has no pending case from;
a. Employer
b. National Bureau of Investigation
c. Philippine National Police
5. Affidavit of Publication from the publisher and a copy of newspaper clippings
6. In case of Correction of Sex/Gender,
The Petition shall be supported with a Medical Certificate by an accredited Government Physician that the Petitioner has not undergone sex change or sex transplant.
7. Payment of Fees
The City or Municipal Civil Registrar is authorized to collect from every petition Three Thousand Pesos (P3,000) for Petition to Correct the Day and/or Month of the Date of Birth or Sex.
Indigents are exempted to pay provided there is a certification of Indigency from the City/Municipal Social Welfare Office.
